1. Giriş
Biz, Birch Games Oyun Yazılım ve Pazarlama A.Ş. (kısaca “Birch” veya “Birch Games” olarak anılacaktır) olarak, mobil oyunlar tasarlayan ve geliştiren bir teknoloji şirketiyiz. İşbu Gizlilik Politikası ile çevrimiçi ve çevrimdışı veri işleme uygulamalarımızı, toplayabileceğimiz bilgi türlerini, bu bilgileri nasıl kullanmayı, işlemeyi, saklamayı, korumayı, açıklamayı ve paylaşmayı planladığımızı ve bu bilgilerin kullanımından nasıl vazgeçebileceğinizi veya bu bilgileri nasıl düzeltebileceğinizi veya değiştirebileceğinizi açıklamayı amaçlamaktayız.
Bu Gizlilik Politikası, web siteleri, mobil uygulamalar, forumlar ve Birch'in her türlü platformu ile tarafımızca sağlanan diğer tüm çevrimiçi veya çevrimdışı hizmetlerimiz, tüm platformlarda gerçekleştirdiğimiz pazarlama ve reklam faaliyetleri ve zaman zaman size sunabileceğimiz diğer hizmetlerimiz için geçerlidir. Bu Gizlilik Politikası'nda, oyunlarımızdan, web sitelerimizden ve diğer hizmetlerimizden (bundan böyle “Hizmetlerimiz” olarak anılacaktır) bahsedilmektedir.
Mobil uygulamamızı indirerek, oyunlarımıza erişerek ve/veya oynayarak, web sitelerimizle veya Hizmetlerimizle etkileşime girerek veya bizimle herhangi bir şekilde iletişim kurarak, bilgilerin ve işlemlerin niteliğine uygun olarak, mevcut teknik imkanlar dahilinde hakkınızda bilgi toplayabiliriz. Kişisel bilgilerinizin ve verilerinizin, bu Gizlilik Politikası'nda belirtilen format ve amaçlarla sınırlı kalmak üzere, Birch tarafından ve/veya Birch aracılığıyla sınırlı bir şekilde kullanılabileceğini kabul ve taahhüt edersiniz. Bize veri sağlamanız veya bu Gizlilik Politikası'nda açıklanan şekilde kullanılması konusunda başka endişeleriniz varsa, oyunlarımızı veya diğer Hizmetlerimizi kullanmamalısınız.
Lütfen Birch’ün; Platformların eylemlerinden, sitelerinin içeriğinden, onlara sağladığınız bilgilerin kullanımından veya sundukları herhangi bir hizmetten sorumlu olmadığını dikkate alınız.
Birch undertakes to keep your data and any confidential information strictly private and confidential, without prejudice to the contents hereof, to regard it as an obligation to keep confidentiality, to take all measures and act in due diligence to prevent all or any part of your information from entering into the public domain or be subject to unauthorized use, or to take measures to prevent the confidential information from disclosure to any third party. If, despite all necessary data security measures taken by Birch, the confidential information is damaged because of attacks on the system or captured by third parties, Birch shall have no responsibility with that respect. Birch shall not be responsible for damages caused by the use of information that you disclose in comments or messages given by third parties in public areas. If you share your name, password, etc. used by you when creating the membership record with third parties, the Birch shall not be responsible for any damages that may arise from the information shared with third parties.
Birch, işbu Gizlilik Politikası'nda dilediği zaman tek taraflı olarak değişiklik yapma hakkını saklı tutar. Hizmetlerimizi kullanmaya devam etmeniz, Gizlilik Politikası'nda yapılan söz konusu değişiklikleri kabul etmeniz anlamına gelir.
2. Veri Sorumlusu
Veri sorumlusu, İstanbul Ticaret Sicili’ne 1041239 sicil numarası ile kayıtlı ve Cihannüma Mahallesi, Faruk Canıtez Sokak, No: 8, Beşiktaş, İstanbul, Türkiye adresinde bulunan Birch Games Oyun Yazılım ve Pazarlama A.Ş.'dir.
3. Topladığımız Kişisel Veriler
Kimliği belirli veya belirlenebilir gerçek kişilere ilişkin her türlü bilgi, kişisel veri niteliği taşır. Kişisel verilerinizin işlenmesi; bu veriler üzerinde gerçekleştirilen elde etme, kaydetme, depolama, muhafaza etme, değiştirme, yeniden düzenleme, açıklama, aktarma, edinme, erişilebilir kılma, sınıflandırma veya kullanılmasının engellenmesi gibi her türlü işlemi ifade eder.
3.1. Doğrudan Sizden Toplanan Kişisel Veriler
Oyunlarımızı indirerek, erişerek ve/veya oynayarak ya da diğer Hizmetlerimizi kullanarak, kişisel verilerinizin Birch tarafından toplanmasına rıza göstermiş olursunuz. Hizmetlerimizi Platformlar aracılığıyla kullandığınızda, Birch sizden ve/veya cihazınızdan belirli kişisel verileri toplayabilir. Bu verilerin çoğu doğrudan sizden veya cihazınızdan gelir; benzersiz cihaz kimliğiniz (kalıcı/geçici), cihazınızın işletim sistemi, sürümü, modeli, işlemcisi (CPU), RAM ve disk alanı miktarı, donanım türü, Reklam Tanımlayıcısı (IOS cihazlar için IDFA ve Android cihazlar için GAID), reklam kimliği, işletim sistemi (“OS”) sürümünüz, cihaz adınız, oyun merkezi/game center kimliğiniz ve İnternet Protokolü (“IP”) adresinize dayalı konum bilginiz bu verilere ilişkin örnek teşkil eder.
Bu verileri, oyunlarımızı ve Hizmetlerimizi size sunmak, size daha iyi hizmet sağlamak, önerilerde bulunmak, hizmetlerimizi geliştirmek ve güncellemek, ilgi ve tercihlerinize yönelik çalışmalar kapsamında Hizmetlerimizin kullanımını kolaylaştırmak, optimizasyon, kişiselleştirme ve oyun içi tekliflerde bulunma ile satın almaların doğrulanması amaçları doğrultusunda ve yasal mevzuat çerçevesinde kullanıyoruz. Ayrıca, bu verileri işbu Gizlilik Politikası'nda belirtilen amaçlar için de kullanabiliriz.
Uygulama içi satın alma ödemeleri, Platformlar tarafından gerçekleştirilmektedir. Birch, ödeme işlemi için Platformlarla paylaştığınız ad, soyad, kredi kartı numarası ve e-posta adresi gibi kişisel verileri toplamaz; kredi kartı ya da banka hesabı verilerinize erişimi yoktur. Bununla birlikte, satın aldığınız ürünlere ilişkin siparişin ifası amacıyla Platformlar, tarafımıza finansal nitelik taşımayan ödeme bilgilerini paylaşabilir.
3.2. Üçüncü Taraflardan Toplanan Kişisel Veriler
Yukarıda belirtildiği üzere, sizinle ilgili topladığımız bilgilerin çoğu, oyunlarımızı oynadığınızda veya internet sitelerimiz, reklamlarımız ya da diğer Hizmetlerimizle etkileşime geçtiğinizde doğrudan sizden elde edilmektedir. Ancak, üçüncü taraf şirketlerin kişisel verilerinize erişmesine izin verdiğiniz durumlarda (örneğin, mobil uygulamalarımızı Platformlar üzerinden indirmeniz halinde), bu Platformlardan da sizinle ilgili bilgi toplayabiliriz.
a. Facebook Hesabının BağlanmasıHizmetlerimize Facebook hesabınız aracılığıyla bağlandığınızda, Birch ad ve soyad bilgilerinizi toplayabilir. Facebook hesap bilgilerinizle Birch profilinize giriş yaptığınızda, bazı Facebook hesabı bilgileriniz tarafımıza iletilir. Oyunlarımızı çevrimiçi olarak oynamayı tercih ederseniz, temel Facebook hesap bilgileriniz otomatik olarak Birch profilinizle ilişkilendirilir. Alınan bilgiler tam olarak Facebook kimliğiniz, profil fotoğrafınız ve adınızdır. Bu sayede, hesabınızı birden fazla cihazda kullanarak giriş yapabilir ve ilerlemenizi bu cihazlar arasında senkronize edebilirsiniz. Kullanılabilir olduğunda, aynı oyunu oynayan arkadaşlarınızı ve oyunlardaki ilerlemelerini görebilecek (onlar da sizi ve ilerlemenizi görebilecek), ya da oyunlarımızda ve diğer Hizmetlerimizde sunduğumuz arkadaş davet etme gibi diğer işlevlere erişebileceksiniz. Facebook hesabınızla ilişkilendirilmiş e-posta adresi ve oyunlarımızı hâlihazırda oynayan Facebook arkadaşlarınıza ait ad ve avatar bilgileri de Birch tarafından işlenmektedir.
Facebook hesabınızı ilk kez Birch profiliyle ilişkilendirdiğiniz anda açılan izin penceresi üzerinden, e-posta adresinize erişim yetkisini reddetme seçeneğiniz bulunmaktadır. Facebook ile oturum açmanız, izniniz olmaksızın sayfanızda herhangi bir paylaşımda bulunmamıza olanak tanımaz ve oyunlarımızı oynamayan Facebook arkadaşlarınıza ilişkin herhangi bir bilgi tarafımıza iletilmez. Facebook arkadaşlarınızın, oyundaki varlığınızı ve ilerlemenizi görmesini istemiyorsanız, oyunumuzla Facebook bağlantınızı keserek ve Facebook ayarlarınız üzerinden uygulama izinlerinizi güncelleyerek bunu engelleyebilirsiniz. Facebook verilerinizin nasıl paylaşıldığını tam olarak anlamanız için, Facebook’un Gizlilik Politikası'nı (https://www.facebook.com/privacy/explanation) okumanızı ve gizlilik ayarlarınızı belirli aralıklarla gözden geçirmenizi tavsiye ederiz.
Facebook hesabınızı bağlamadan Birch profili oluşturmayı tercih etmeniz halinde, oyunlarımızı oynadığınızda topladığımız kişisel veriler anonim olacaktır. Ancak, cihaz düzeyindeki tanımlayıcılar ile bu tanımlayıcılarla ilişkili bazı bilgiler her halükarda toplanacaktır; bu bilgiler şunları kapsar:

If you choose not to create a Birch profile by connecting your Facebook account, the personal data that we collect when you play our games will be anonymous, but we will collect device level identifiers and other information associated with those identifiers including:

iii. Profil fotoğrafınız, adınız ve soyadınız, oyun kullanıcı adınız (kullanıcı adınız ve puanınız, puan tablosu özelliği bulunan oyunlarımızda diğer kullanıcılar tarafından görüntülenebilir).
b. App Store ve Google Play Store Üzerinden Mobil Uygulamalarımızın Yüklenmesi:Mobil uygulamalarımızla ilgili öğeleri (örneğin, Platformlar üzerinden satın alabileceğiniz veya indirebileceğiniz içerikler) yüklediğinizde veya satın aldığınızda, Birch’in kredi kartı ya da banka hesabı bilgilerinize erişimi bulunmamaktadır. Ancak, yukarıda belirtilen Platformlar, siparişinizin ifası amacıyla, satın alınan öğeler gibi finansal nitelik taşımayan ödeme bilgilerini bizimle paylaşabilir. Platformlardan alınan kişisel veriler, ilgili Platform uygulamalarındaki gizlilik şartlarına bağlı olacaktır.
c. Web Siteleri:Web sitemizde iş başvuru formu doldurduğunuzda, özgeçmişinizi yüklediğinizde veya formları doldurup ek bağlantılar sağladığınızda bize verdiğiniz her türlü bilgi.
4. Kişisel Verilerinizi Nasıl Topluyoruz?
Cihazınıza Hizmetlerimizi indirdiğinizde veya kullandığınızda, bize geri bildirimlerinizi gönderdiğinizde veya bilgilerinizi ya da destek taleplerinizi doğrudan Birch'e ilettiğinizde; Facebook, Apple App Store ve Google Play Store'dan (birlikte “Platformlar”) ve onayınızı almış veya bu tür kişisel verileri bizimle paylaşma konusunda yasal hakkı bulunan iş ortakları veya diğer üçüncü taraf şirketlerden (reklam platformları, ortakları ve veri toplayıcıları dahil) otomatik olarak kişisel veriler toplayabiliriz. Bu veriler, sizinle ve ilgi alanlarınızla ilgili özelliklerin yanı sıra kullandığınız diğer oyunlar ve hizmetlerimiz, demografik bilgiler ve genel konum bilgilerini içerebilir. Kişisel verilerinizi işbu Gizlilik Politikası'nda açıklandığı şekilde kullanacağız.
5. Kişisel Verilerinizin İşlenme Amaçları
Kişisel verileriniz ile diğer hesap bilgileri ve içerikleriniz; aşağıda belirtilen amaçlar ile işbu Gizlilik Politikası’nda yer alan diğer amaçlar doğrultusunda, ayrıca bu Gizlilik Politikası’nda açıkça belirtilen diğer hâllerde veya yürürlükteki yasal düzenlemelerin gerektirdiği durumlarda, aksi açıkça belirtilmedikçe, toplanabilir, erişilebilir, saklanabilir, açıklanabilir ve kullanılabilir.
a. Hizmetlerimizi Sunmak ve Optimize EtmekKişisel verilerinizi; oyunlarımızı sunmak, satın aldığınız içeriklerin oyunlar içerisinde etkinleştirilmesini sağlamak ve ihtiyaç duymanız hâlinde size oyuncu desteği sunmak için kullanırız. Oyunlarımızı sizin ve kullandığınız cihazın özelliklerine göre optimize etmek, size özel oyun içi etkinlikler, teklifler ve promosyonlar sunmak amacıyla işleriz. Bununla birlikte, oyunlarımızı ve diğer hizmetlerimizi işletmek, iyileştirmek ve optimize etmek; hizmetlerimizin belirli alanlarına, işlevlerine ve özelliklerine erişim sağlamak; web sitelerimizi, reklamlarımızı ve diğer hizmetlerimizi size sunmak ve tüm bunları sizin ve diğer tüm oyuncularımız için mümkün olan en iyi hâle getirmek amacıyla kişisel verilerinizi kullanırız. Ayrıca, iç kalite kontrolünü sağlamak; hizmetlerimizi kişiselleştirmek; kullanıcılarımızı ve tercihlerini anlamak; hizmet deneyimini ve hizmetlerimizi kullanırken alınan memnuniyeti artırmak için de kişisel verileriniz işlenir. Bu kapsamda, web sitelerimizin tüm cihazlarda düzgün çalıştığından ve tüm oyuncular için mümkün olduğunca keyifli bir deneyim sunduğundan emin olmak amacıyla toplu verilerin kullanımı ve analizi gerçekleştirilmektedir.
b. Müşteri Hizmetleri: İletişim kurmak vasıtasıyla bize doğrudan sağladığınız kişisel veriler, örneğin e-posta adresiniz gibi iletişim bilgileriniz, ihtiyaç duymanız hâlinde veya herhangi bir şekilde bizimle iletişime geçtiğinizde, müşteri hizmetleri kanallarımız aracılığıyla size teknik destek sağlamak amacıyla kullanılmaktadır. İletişim bilgileriniz; taleplerinizi yerine getirmek, sizinle iletişim kurmak, müşteri hizmetleri kapsamında destek sunmak veya oyunlarımız ve Hizmetlerimiz hakkında size güncellemeler göndermek amacıyla işlenir. Son olarak, kişisel verileriniz hesabınızı ve bizimle olan ilişkinizi yönetmek ve Hizmetlerimizi kullanırken deneyiminizi iyileştirmek amacıyla kullanılabilir.
c. Kullanıcı Yorumları ve Görüşleri: Zaman zaman, oyunlarımız hakkındaki yorumlarınızı paylaşabilir ve kişisel veriler içerebilecek belirli bilgileri bize gönüllü olarak iletebilirsiniz. Bu tür yorumlara katılımınız sırasında toplanan tüm kişisel veriler tamamen gönüllülük esasına dayanmaktadır. Toplanan bu kişisel verileri, karşılaştığınız sorunları çözmek, taleplerinizi yerine getirmek, yorumlarınıza ve sorularınıza yanıt vermek, müşteri destek hizmetleri sunmak amacıyla kullanabiliriz. d. Analizler ve Araştırma: We use analytics tools, which may include third party analytics tools, to collect information about how you play our games or use our Services. Those tools may use cookies or other similar tracking technologies. We may use your data to measure interest in our Services; and to carry out research, surveys or to engage directly with you, for example by sending you communications (including by email), for these purposes.
e. Pazarlama, Promosyonlar ve YarışmalarZaman zaman promosyonlar veya yarışmalar düzenleyebiliriz ve bu süreçte, adınız, adresiniz, posta kodunuz, e-posta adresiniz veya bir ödül talep etmeniz amacıyla sunduğunuz diğer bilgi ya da içerikler gibi bazı kişisel verilerinizi toplayabiliriz. Bu yarışmaların kendilerine özgü hüküm ve koşulları olacaktır; ancak, yarışmayı gerçekleştirmek amacıyla, ilgili yarışmayla bağlantılı olarak sağladığınız kişisel verileri kullanacağız. f. Bildirimler: Verilerinizi, onay mesajları, teknik bildirimler, güncellemeler, yeni ürün duyuruları, güvenlik uyarıları, destek hizmetleri ve idari mesajlar dahil olmak üzere hizmetlerimizle ilgili bilgileri size iletmek amacıyla kullanabiliriz.
g. Sohbet: Hizmetlerimizin bazıları sohbet işlevi içermektedir. Sohbet hizmetlerimizi kullanan kullanıcılar, diğer oyunculara mesaj gönderebilir. Mesajlarınız tarafımızca şu amaçlarla kullanılabilir ve saklanabilir: (a) mesajlarınızı iletmek; (b) sizin ve alıcılarınızın mesaj geçmişini görüntüleyebilmesini sağlamak (ancak tarafımızca belirlenen ilgili sürenin sonunda oyun içi sohbet mesajlarınıza erişilemeyeceğini lütfen unutmayın); (c) oyuncular olarak oyunlarda ya da sosyal medya hesaplarımızda birbirinizle iletişim kurmanızı sağlamak. Hizmet şartlarımıza uyduğunuzdan emin olmak amacıyla, mesajlarınızın içeriğini otomatik filtreler dahil olmak üzere inceleme hakkımızı saklı tutarız. Ayrıca, sohbet hizmetimizi kullanmanızı engelleme veya herhangi bir mesajın gönderimini herhangi bir nedenle durdurma hakkımız da saklıdır.
h. Hile, Suç ve Dolandırıcılığın Önlenmesi:: Elimizde bulunan kişisel verileri, hile, suç ya da dolandırıcılığı önlemek; potansiyel olarak yasaklanmış ya da hukuka aykırı faaliyetleri engellemek ve oyuncularımızı korumak amacıyla kullanabiliriz. Bu kapsamda, verilerinizi dolandırıcılığı önleme kurumları ve polis gibi suç ve dolandırıcılıkla mücadele eden kolluk ve kuruluşlarla paylaşabiliriz.
i. İşe Alım: Web sitemizde yer alan iş başvuru formunu doldurmanız veya özgeçmişinizi ve eklediğiniz diğer belgeleri/bilgileri tarafımıza iletmeniz halinde, bu bilgileri işe alım süreçlerimiz kapsamında sizinle iletişim kurmak amacıyla kullanabiliriz.
j. Hakların Korunması: Elimizde bulunan kişisel verileri, sizin, bizim veya üçüncü kişilerin haklarını, mülkiyetini ya da güvenliğini korumak; Birch Games'in politika ve sözleşmelerini uygulamak; ya da Birch Games’e olan borçların tahsili amacıyla kullanabiliriz.
k. Yasal Amaçlar ve Mevzuata Uyum: Verilerinizi, yürürlükteki mevzuatın gerektirdiği veya izin verdiği ölçüde kullanabiliriz. Bu veriler, tarafımıza uygulanan yasal yükümlülüklere uymak, kolluk kuvvetleri veya ulusal güvenlik kurumlarının taleplerini ve mahkeme emirleri ya da celp gibi yasal süreçleri yerine getirmek; hizmet şartlarımıza uyumu sağlamak veya gerektiğinde hukuki haklarımızı savunmak, kullanmak ya da tesis etmek amacıyla kullanılabilir. Ayrıca, fiziksel zarar veya maddi kaybı önlemek amacıyla ya da şüpheli veya fiili yasa dışı faaliyetlerin soruşturulması veya kovuşturulmasıyla bağlantılı olarak açıklamanın gerekli veya uygun olduğuna inandığımız durumlarda da veriler kullanılabilir. Ek olarak, zaman zaman güvenlik amacıyla sunucu günlükleri incelenebilir (örneğin, Hizmetlerimizdeki yetkisiz faaliyetlerin tespiti için). Bu tür durumlarda, IP adreslerini içeren sunucu günlük verileri, yetkisiz faaliyetlere ilişkin soruşturmalar kapsamında kullanıcıların kimliklerinin tespiti için kolluk kuvvetleriyle paylaşılabilir.
5. Kişisel Verilerinizin İşlenmesine Dair Hukuki Dayanaklar
Kişisel verileriniz, yalnızca yürürlükteki mevzuat uyarınca hukuki bir dayanağımızın bulunması hâlinde toplanır ve işlenir. Bu kapsamda dayandığımız hukuki sebepler şunlardır:
a. Explicit consent and/or your request: This is used as a legal basis in the following contexts; the collection of data stored on your device by us and our advertising partners, including device information, ad identifiers, IP address, country and region. You consent to this collection when you agree to install our game and you can withdraw your consent to this by uninstalling our games. In data processing activities where your personal data is processed based on the explicit consent, you have the right to withdraw your consent at any time.
In this Privacy Policy we have explained how you can opt out of certain types of processing that we undertake and where any processing is based on your consent, you can withdraw that consent at any time in the ways described in this Privacy Policy. Nonetheless, if you play our game we will still collect some personal data about you and process it as otherwise described in this Privacy Policy. If you do not wish us to collect any personal data about you at all, you should cease playing our games and stop using our Services.
b. Legitimate and Statutory Interests: This covers data used by us for purposes that are not harmful to your privacy and can be reasonably expected within the context of your use of our Services, such as marketing, advertising, analytics, research and optimization of our games and other Services; without prejudice to your fundamental rights and freedoms, being compulsory for our statutory interests. Birch’s statutory interest in processing your device and usage data is to provide better service to you, to make suggestions, to improve its services, to improve and update our Services, to facilitate the use of Services at the works related to your interest and preferences, within the framework of legal legislation.
c. Legal Obligation: This covers data used by us to comply with a legal obligation, such as to maintain records relating to tax or to respond to a valid legal request for certain data; to disclose such information in accordance with applicable laws or regulations or a court judgment or administrative order issued; to fulfil our legal obligations as a data controller.
d. Contractual Necessity: This covers data used by us in order to establish and execute of an agreement; to provide you with Services that you have requested – and that we have agreed – to provide to you, such as our games, customer services, chat functionality and third-party social network connectivity.
e. Exercising Rights: This covers data used by us in order to establish, exercise, and protect any right; and in cases where it is necessary.
6. The Transfer of Your Personal Data
In case a public institution is authorized to request personal data by the law, your personal data can be transferred to such authorized public institution in accordance with the applicable personal data protection legislations. Requests from judicial authorities will also be fulfilled in accordance with the applicable legislation.
Your personal data may be transferred to our business partners and service providers only if it is required to provide Services with you. The types of Service Providers (data processors) to whom we entrust include companies that provides:
(i) provision IT and related services;
(ii) provision of information and services you have requested;
(iii) customer service activities;
(iv) analytics and search engine activities that assist us in the improvement and optimization of the Services; and
(v) any supporting activities in connection with our Services. ii. the games you play and information about how you interact with our games and Services;

9. Ad identifiers, Software Development Kits and Similar Technologies

Account deactivation: Should you wish to completely deactivate your account include disassociating your Facebook account from our current and future mobile games and deleting our games from your mobile devices. Please note that if you completely deactivate your account all your progress in our games and any unspent virtual items will be lost and we may not be able to restore them in the future.
d. Restriction on processing of personal data: You may have the right to ask BirchGames to restrict the use of your personal data, when certain conditions apply.
e. Object to processing of personal data: You may have the right to object to the use of your personal data by Birch Games, when certain conditions apply.
f. Portability of personal data: You may have the right to receive your personal data in a structured and commonly used format so you can use this data with another company, when certain conditions apply.
g. Rights under Personal Data Protection Law: The GDPR is a regulation intended to strengthen and unify data protection for all individuals within the EU; and KVVK (Personal Data Protection Law) is a regulation intended to strengthen and unify data protection for all individuals within Turkey. It aims to protect the fundamental right to privacy and the protection of personal data. Birch Games is committed to data protection and has taken steps to align with the laws.
h. Opting-Out: We may occasionally send you push notifications through our mobile applications with game updates, high scores and other notices that may be of interest to you. You may at any time opt out from receiving these types of communications by changing the settings on your mobile device.
i. Complaining: If you believe we have misused your data or violated any data protection regulations, you may file a complaint with a Data Protection Authority, for example, the Authority of your place of residence. You can submit all your claims, deletion requests and questions with respect to such rights. Your requests will be answered as soon as possible and within thirty days at latest.
j. Others: There are other ways in which you can control the personal data that we collect about you. For instance, you could disconnect your Facebook or other social network account from our games, or delete our games from your mobile device. You could also reset your mobile advertising identifier or limit ad tracking altogether using the settings in your phone.
You can exercise your rights to review or request the permanent deletion of your personal data by submitting a request to our support team. If you do not want to permanently delete your account, you may deactivate your account instead, and activate it again any time. Please be advised that by deleting your personal data, all game progress and any related asset will no longer be restorable.

Most of Birch Services and games are not intended for children under the age of 18 and Birch does not knowingly collect or solicit personal data about or direct or target interest-based advertising to anyone under the age of 18 or knowingly allow such persons to use Birch Services.
You must be over 18 years old to play our games and use our Services. We do not collect personal data from anyone under 18 years old knowingly and willfully. However if the Services are used by such a person in contradiction to this Privacy Policy, we may collect personal data from such a person.
